How Do Restrictive Covenants Affect the Buyers of Homes for Sale?

Restrictive covenants (also called deed covenants) have been affecting buyers of real estate for as long as property has been transferring ownership. Such covenants are a condition of sale for real property, placed on the buyer by the seller or passed on from previous owners. By purchasing the property, the buyer agrees to abide by these restrictions on the use of the property.

Restrictive covenants are especially important to buyers of homes for sale; since they, like zoning laws, restrict how you may use your own property. Where city officials enforce public zoning laws, private parties enforce restrictive covenants ? generally a homeowners association or individuals who are affected by violations.



Restrictive homes for sale covenants protect the value of the home, itself, as well as the properties surrounding it. Some homes for sale covenants protect the people who live in close proximity to the property, such as other condominium or townhouse owners.

In earlier and not so charitable times, such covenants restricted to whom you could sell your home. Upscale areas of a city wanted to keep their neighborhoods free of particular races or ethnic groups. In the ?50s and ?60s, such covenants were deemed unconstitutional by the 5th and 14th Amendments to the U.S. Constitution, as well as unlawful by federal and state statutes.

Now, such homes for sale covenants are imposed to maintain a certain character and appearance of the neighborhood. Some homes for sale covenants are very restrictive ? for example, you cannot leave your trashcan in the street for more than one hour after trash pickup. Some homes for sale covenants dictate the maximum length of your grass or the exterior color of your home. Some control such mundane things as what type of pet you can own (if any), and during which hours of the day you can vacuum your carpets.

Violations of homes for sale covenants have serious consequences. You may be fined for most offenses; however, costly lawsuits have occurred from unresolved violations.

It is not the seller?s responsibility to alert a buyer to restrictive covenants on homes for sale. The restrictive covenants generally are on file with the county in which the homes for sale is located. During the purchase process, a title search or abstract update should expose and highlight any covenants for the buyer and his/her real estate attorney to review before the purchase of the homes for sale.

Unfortunately, this process does not occur until after a homes for sale buyer has made an offer. That means a buyer always should check for restrictive covenants BEFORE making an offer on a homes for sale, or AT LEAST make the offer subject to review and acceptance of all covenants.

The most difficult aspect of property ownership, by far, is remodeling and the management of contractors. More on this later. When it comes to managing tenants, however, the biggest advantage that you have is the property that you bought. If it's a great property, your units will attract great tenants and they will always be full. If it's not a great property, then life gets more complicated. It's better to have your units empty than it is to rent to a bad tenant. We know the preceding sentence may be a little hard to digest for the first-time property owners, but it's absolutely the case that bad tenants will cause you more problems down the road than any rent is worth.

Here are some time-proven and foolproof ways to screen tenants:



Be observant! And observation starts from the moment that the prospective tenants walks up to the unit! Observe the vehicle that they drive, the clothes that they wear, whether they make eye contact, what type of questions do they ask, how observant are they, etc.?

Questions. People who intend to be great tenants will tend to ask very different questions from people who don't. The great tenants ask questions like the following:

What are the other tenants in the building like? Do they stay up late, do they smoke, are they loud?
What do the other tenants do for a living?
Where is the nearest park and coffee shop?
If I play my cello at night (which is what I do to relax), do you think I will disturb the other tenants?
Have there been any incidents of crime in this area?

Potentially bad tenants will ask questions like the following:

It's okay if my rent is occasionally late, right? (This will always be followed by some reason like they work in a job that is seasonal so their salaries are unpredictable)
You don't really need three personal references, do you?
You aren't serious about talking to my previous landlord, are you? I can tell you that I'm moving because that guy was a jerk.
When I leave, I'm getting all of my security deposit back, right?

Check all References. Great tenants will have great references and the great references will use descriptive terms, such as, Oh, I've known Frank for 20 years and he's an incredible person! He was the best man at my wedding, and he will be an ideal tenant! Listen carefully to the tone of their voice. If you hear descriptive phrases that are lukewarm or tepid, then you are probably dealing with a person who is a bad tenant. Avoid them. Avoid them. Avoid them. There are many resources for doing a credit reference check and a criminal check if you know where the tenant previously lived. One company that the author has used successfully is Rental Research, Inc. Oftentimes, the report is available on the exact same day. You need to remember that you are not allowed to share the tenant's credit report or credit score with them, although you are allowed to ask them about any discrepancies about which you have a concern (continued late payments, excessive debt, etc.).

Trust Your Instincts! This is, by far, the best advice that I've ever given or received. If, after you've done all of the above, there is something about the prospective tenant that doesn't feel right for whatever reason, don't rent to them. Your instincts are telling you something subconsciously that you need to respect.

What About Pets? Some property owners allow only small pets in their buildings, and we can completely understand why. Large pets wear considerably more on the investment property than small pets, not to mention that poorly behaved large pets cause more damage, not to mention that the pet can annoy other tenants. Our collective experience with pets is that the behavior of the pet tracks closely to the behavior of the tenant. Just like you check references for the tenant, you should check references for the pet. Some time-proven tips:

Call people who know the pet and who have watched the pet in the past, and ask them the same questions you would ask about the tenant.

Meet the pet in person (so to speak). Spend some meaningful time with pet and see if the pet behaves inappropriately while you are interacting with the pet. If the pet jumps up and knocks you to the ground, that is a bad sign. I know an emu named Bob who likes to lick my ear, but that's a socialization behavior of emus, and I don't encourage renting to anyone who has an emu. Speak to the pet and see if the pet responds to your voice.

Observe how the pet interacts with the owner and vice versa. Owners who treat their pets like children will have a higher probability of having well-behaved pets. There are always exceptions, but the odds are in your favor if the pet is treated like a child, but not a spoiled child.

Observe the living conditions of the pet. Personally, I worry about pets who spend most of their time alone or who live outside in the backyard by themselves, particularly if the pet is a dog. Dogs are social creatures -- they are pack animals by nature and they need companionship.

Observe the grooming of the pet. Well behaved pets are typically well-groomed, with clipped nails, brushed hair and no fleas or ticks.

Pay attention to the name of the pet. I know this one is silly, but it makes a difference. I would worry about a dog named Killer, Brutus or Caligula. On the other hand, I like any pet named Muffy or Munchkin.

If you're like most real estate investment wannabes, you've taken seminars, read books, watched infomercials and DVDs, and have spent considerable amounts of money to learn about the ins and outs of the field. The first has become popular with the advent of several television programs. It's popularly known as flipping houses, which just means buying, fixing up, and reselling a property for a profit. There are dangers, of course, since many projects have at least one hidden problem that throws a giant monkey wrench into the process, reducing profits and lengthening the time to finish. Therefore, it's important for you to know your market and how much things will cost to repair before you start working this popular investment strategy.

Lease options can also be a profitable way to get into a rundown house, bring it up to standard, and then either resell or rent it, depending upon your taste. This allows you to generally get into a house without the real estate agent's fees, which can be considerable. Once you've got the property up to standard, you can then sell the home on a lease option to someone else, which is generally good, because they'll have more incentive to keep it nice.

There are many other ways to make money in real estate, of course, but these are some investors favorites. The main thing is to pick a strategy you're comfortable with and stick to it until you're an expert at it!

13. Leave the table immediately after youve finished eating. Avoid desserts or have a cup of low fat yogurt.

14. When you are home and craving an extra rich treat, tie on your walking shoes and go for a walk. By the time you get home the craving most probably will have passed.

15. Walk for at least 30 minutes a day. This can be broken into two, five minute increments, if desired.

16. Park your car at the outside edge of the parking lot, where its much easier to get a parking space, and then walk to the store. This will help you get in your minimum daily requirement of walking.

18. Eat a bowl of broth based soup, such as minestrone or vegetable, before eating your meal. This will take the edge off your hunger and you will eat less. Do not eat cream soups, as they are much higher in calories.

19. Reward yourself once a week with a small treat. This helps you to avoid binging and brings weight loss success.

20. Learn to love yourself as you are. Beauty is in the heart and soul. Remind yourself that you are beautiful.

21. Never eat anything after 8 pm.

22. Write down everything you eat. This helps you keep tabs on your food intake. Youll be surprised at how quickly it adds up.

23. Keep food off the table. Place single servings on plates and put them at the place settings. Youre more apt to take seconds if the food is within easy reach.

24. Eat vegetables first. Vegetables have lots of fiber, which helps make you feel full before you get to the carbohydrates and fat.

25. Put your fork down between mouthfuls of food. Chew thoroughly and swallow before picking up your fork for the next bite. This allows you to savor your food and it helps you to eat slower, which improves digestion.

While its very clich? to say that you are what you eat, there is a lot of truth to this statement. Lets look deeper at this statement and think about some every day examples and evidences of this statement as well. Think about the last time you went to an all-you-can-eat buffet. For the most part, what was the overall physical condition of the people eating there? You make the call: are people that eat in the style of an all-you-can-eat buffet becoming what they eat? Does eating large amounts of food high in fat make your body react a certain way? Of course it does! Granted, this is some what of an extreme example, but the concept is true. Eating clean and reducing highly processed foods, lots of sugar, and the wrong types of fat will definitely help your body composition. For a great example of this, see the movie Super-size Me.

Resistance Training

There are many different types of resistance training that are effective. Weight training, pilates, yoga all can be effective ways to get your body moving. Why is resistance training than cardio training? Because resistance training helps to build muscle more than anything else. Simply put, if your body has more muscle it tends to function and burn fat more effectively. So in summary, resistance training does more than just get your heart pumping and your muscles burning, but it builds muscle and improves your overall physical appearance and condition.

Cardio Training

As with resistance training, there are many ways to do cardio training: running (either outdoors or on a treadmill), biking, using an elliptical trainer, stair climber, rollerblading, and many more. There are several reasons why you should include cardio training in your natural weight loss or maintenance program. One of the main reasons is that doing cardio helps your body to burn more fat. Cardio will really get your heart pumping and will also put your body in a prime stat to burn more calories. Another reason to do cardio is overall conditioning. Do you find yourself getting easily winded when doing normal things like going up a staircase? Cardio training will help your body get used to that type of work.

In summary, for a natural weight loss or maintenance program to truly be effective and work over a longer period of time, you need to include proper nutrition, resistance training, and cardio training. These are the three pillars of your program and if any one of them is missing or being in some way neglected you will find that your program is not working as well as you might have hoped. When it comes to using supplements, remember that they are only supplemental to what you are already doing, hence the name supplements.
